Contact with relatives in care homes during lockdown

Sophie Maloney, a solicitor in the Court of Protection and community care department at national law firm Stephensons, looks at how the latest national lockdown legislation impacts care home visits.

Throughout the pandemic, concerns about the inability to visit and speak with family members in care homes have been widely reported, with different care providers taking different approaches to facilitating contact.

Now that we are in what is being called the third lockdown, with all of England being placed into the Tier 4 category, new regulations and guidance have been published by the government.

In respect of the third national lockdown that commenced on 5 January, The Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020 apply. Schedule 3A specifies the Tier 4 restrictions.
